1. Acceptance of Terms

By accessing or using www.homeschoolmarianna.com (the “Site”) or enrolling in programs offered by Kids By Design LLC (“Company,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please discontinue use immediately.

2. Eligibility

Our services are intended for parents, guardians, and adult caregivers. You must be at least 18 years old to use the Site or register a child for programs.

3. Programs and Enrollment

  • Enrollment in classes and programs is subject to availability and confirmation by the Company.

  • Parents or guardians are responsible for providing accurate information during registration.

  • The Company reserves the right to refuse or cancel enrollment at its discretion.

4. Payment and Refunds

  • Payment is due at the time of registration unless otherwise agreed.

  • Fees are non-refundable except where required by law or as specifically outlined in program policies.

  • Late or failed payments may result in suspension or termination of services.

5. Parent/Guardian Responsibility

  • Parents/guardians are responsible for their child’s safety, conduct, and participation in all programs.

  • The Company is not liable for injuries or damages occurring outside supervised activities.

  • Parents/guardians agree to notify the Company of any allergies, medical conditions, or special accommodations needed.

6. Code of Conduct

We strive to create a safe and respectful environment. By using our services, you agree that you and your child will:

  • Treat staff and peers with respect

  • Follow all rules and instructions provided

  • Not engage in disruptive, harmful, or unlawful behavior

Failure to comply may result in removal from programs without refund.

7. Intellectual Property

All content on the Site, including text, images, logos, class materials, and curricula, is the property of Kids By Design LLC or its licensors and may not be copied, distributed, or reproduced without permission.

8. Limitation of Liability

To the fullest extent permitted by law, Kids By Design LLC is not liable for:

  • Any indirect, incidental, or consequential damages arising from the use of the Site or participation in programs

  • Injuries, losses, or damages not caused by our direct negligence

  • Third-party services, websites, or links

9. Indemnification

You agree to indemnify and hold harmless Kids By Design LLC, its employees, contractors, and affiliates from any claims, damages, or expenses resulting from your or your child’s use of the Site or participation in programs.

10. Termination

We may suspend or terminate access to the Site or services at our discretion, with or without notice, if these Terms are violated.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

12. Changes to Terms

We may update these Terms from time to time. Updates will be posted on this page with a new “Effective Date.” Continued use of the Site or services after changes indicates acceptance.
